{"id":273,"date":"2026-04-23T06:42:58","date_gmt":"2026-04-23T06:42:58","guid":{"rendered":"https:\/\/aiandtech.com\/?p=273"},"modified":"2026-04-23T06:49:18","modified_gmt":"2026-04-23T06:49:18","slug":"nintendo-customers-sue-for-share-of-trump-tariff-refunds","status":"publish","type":"post","link":"https:\/\/aiandtech.com\/?p=273","title":{"rendered":"Nintendo Customers Sue for Share of Trump Tariff Refunds"},"content":{"rendered":"<p>Two Nintendo of America customers have filed a lawsuit seeking to make sure any tariff refunds the company receives are passed on to consumers.<\/p>\n<p>The proposed class action, filed Tuesday in the US District Court for the Western District of Washington, says Nintendo of America has not committed to reimbursing customers for costs tied to tariffs that were later voided. The complaint alleges unjust enrichment and says the company violated Washington state consumer protection law.<\/p>\n<p>The filing argues that Nintendo could end up collecting the same tariff-related money twice: once through higher prices charged to customers and again through refunds from the federal government, including any interest paid on those funds.<\/p>\n<p>Nintendo of America, a subsidiary of the Japan-based gaming company Nintendo, did not immediately respond to a request for comment.<\/p>\n<p>The case comes as companies begin seeking refunds for duties paid to the US government under the Trump administration\u2019s 2025 tariffs on foreign trading partners. Those tariffs were imposed using the 1977 International Emergency Economic Powers Act, which was used to justify higher taxes on goods imported from nearly every country.<\/p>\n<p>The US Supreme Court later struck down the tariffs, ruling that the law did not authorize using emergency powers to impose them. Before that ruling, the government had collected more than $160 billion from thousands of companies, including Nintendo of America, according to the lawsuit.<\/p>\n<p>Nintendo raised the price of several accessories by $5 to $10 in April 2025 after the tariffs were imposed, citing changes in market conditions. In August, the company also increased US prices for original Switch hardware, including a $30 increase for the Switch Lite and a $50 increase for the Switch OLED.<\/p>\n<p>Similar lawsuits seeking consumer refunds have also been filed against EssilorLuxottica, the maker of Ray-Ban, and clothing company Lululemon. At the same time, shipping companies FedEx, DHL, and UPS have said they will pass the money on to their customers.<\/p>\n<p>The Nintendo lawsuit was filed by Gregory Hoffert of California and Prashant Sharan of Washington state.
